Strategic Reversal Method: Example Applications

Defendant Uses Strategic Reversal Method

The Problem: Defendant filed a motion to dismiss the foreclosure action because the plaintiff failed to serve him and the process server falsely claimed service. Despite clear video evidence that the process server didn't actually serve the documents, the court ignored the images and determined that the individual was served because she admitted taking papers off her door.

The Solution: By filing an interlocutory appeal, the defendant's counsel was able to very quickly bring a pause to the case and have the appellate court determine clearly that the images demonstrate that the process server didn't serve her.

The Result: The appellate court decided that the case should be dismissed, and the decision was made in nine months because the interlocutory appeal was filed. Within two weeks after filing and getting the appellate number, the appeal was perfected. It happened so quickly that the Supreme Court had not even decided the motion to re-argue, and the case was dismissed.

Plaintiff Uses Strategic Reversal Method

The Problem: A small manufacturing company sued its supplier for breach of contract. The supplier failed to file a timely answer, so the manufacturer's attorney filed a motion for default judgment. Despite no proper affidavit or reasonable excuse being filed, the court refused to enter the default judgment, subjecting the manufacturer to potentially years of additional litigation.

The Solution: The manufacturer's counsel filed an interlocutory appeal and perfected it within days of the appellate index number being issued. Then, near the end of the 30-day timeline, filed a motion to re-argue.

The Result: While the motion to re-argue was still pending, the appellate court reversed the Supreme Court and entered the default judgment. The supplier was able to get a judgment on liability before the motion to reargue was even ruled upon, leaving only damages to determine. The parties settled shortly after, saving years of litigation.
